Paper","subitem_description_language":"ja","subitem_description_type":"Other"}]},"item_10002_description_5":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"近年の憲法九条制定過程に関する研究は、幣原の理想的戦争放棄提案をマッカーサーが憲法化したとするものが有力だが、笠原十九司氏は『憲法九条論争』（平凡社、二〇二三年） で改めて幣原発案説を主張した。だがそれは自説への批判や重要な史料を無視し、史料批判も独善的である。本論では笠原氏からの批判に回答するとともに、氏が議論の中核にした「平野文書」（幣原から天皇の人間化と戦争・戦力の放棄は自らの発案だったと聞いたとするもの）の内容と、文書が生まれた背景の検証により幣原発案説を再否定する。\n　第一に、「平野文書」は、憲法九条幣原発案説の日本側証拠を求めていた憲法調査会会長の高柳賢三の依頼を機縁に、自らの政治生命を維持する手段として幣原発案説を主張していた平野三郎によって作成された。だが、その内容は多分に誤記を含み、趣旨も幣原の思想とは異なり、歴史的経緯とも辻褄が合わない怪文書だった。\n　第二に、「羽室メモ」（幣原がマッカーサーに戦争放棄を提案したとされる一九四六年一月の会談内容を語ったもの）には、憲法調査会に提出される前と後の二つの版が現存し、後者には史料改変の跡がある。笠原氏は幣原が戦力放棄を提案したとする後者のみを使用して筆者を批判したが、筆者が使用した前者には戦力放棄の話はないし、当時の閣議議事録によれば幣原は将来の再軍備を意識しており、前者の方が信憑性が高い。また、両版とも戦争放棄の憲法化は幣原ではなく、マッカーサーによるものであることは共通している。\n　第三に、笠原氏は幣原がＧＨＱ憲法草案に抵抗したとする『芦田均日記』の記述は間違いとし、筆者が引用した『小林一三日記』を存在しなかったかのように批判した。だが、『小林一三日記』には幣原の抵抗がより詳細に記録されているばかりか、笠原氏が主張する幣原と保守派閣僚の対立はなかったことが分かる。笠原氏が『芦田均日記』否定の根拠とした入江俊郎の著書も、入江の主観が混ざった後年の編纂物で、歴史史料としては不適切である。\n　以上の三点は、笠原氏の主張する憲法九条幣原発案説の重要な部分を占めるが、氏が用いた史料とその史料批判は極めて稚拙で、筆書は笠原説を全面的に否定した。","subitem_description_language":"ja","subitem_description_type":"Abstract"}]},"item_10002_full_name_24":{"attribute_name":"著者別名","attribute_value_mlt":[{"names":[{"name":"Taneine,
